These Terms and Conditions apply to all purchases made through our online store https://www.jkfabrics.nl By placing an order, you agree to these Terms. 

2. Definitions

  • Consumer: A natural person acting for purposes outside their trade or profession.
  • Distance contract: An agreement concluded between the business and consumer through the online store.
  • Cooling-off period: The 14-day period during which a consumer may withdraw from the contract. 

3. Applicability and Agreement

These Terms apply to all offers, orders, and contracts made between JK Fabrics and consumers.

An agreement is concluded once you have completed your order and received an order confirmation from us by email.

Until we confirm receipt, you may cancel the order.

We reserve the right to verify payment capability and to refuse or attach special conditions to an order if necessary. 

4. Offers and Prices

  • All prices are in euros (€) and include VAT.
  • We aim to ensure that product descriptions and prices are accurate.
  • In case of a pricing or product information error, we reserve the right to correct it before dispatch. You will be informed and may cancel your order if you do not agree with the corrected price. 

5. Payment

  • Payment must be completed at the time of ordering using the payment methods offered on our website.
  • We do not accept payment by cheque or cash on delivery.
  • Ownership of goods transfers to you only after full payment has been received. 

6. Delivery

  • Delivery will take place at the address you provide.
  • We deliver to addresses within the Netherlands and other EU countries as listed on our website.
  • We aim to deliver orders within 30 days, unless otherwise stated.
  • If delivery is delayed, we will inform you promptly.
  • If delivery is delayed by more than 30 days, you may cancel your order and receive a full refund.
  • The risk of loss or damage passes to you when you (or a person you designate) have physically received the goods. 

7. Right of Withdrawal (Cooling-Off Period)

You may cancel your purchase within 14 days of receiving the goods, without giving a reason.

To withdraw, email [email protected] with:

  • Your order number
  • The items you wish to return
  • A statement that you wish to cancel the order

Return Conditions:

  • Return the goods within 14 days of notifying us.
  • You pay for return shipping unless the goods are faulty or incorrect.
  • We will refund all payments, including original delivery costs (if applicable), within 14 days of receiving the returned goods.
  • Goods must be returned in their original condition and packaging, including accessories, unless defective or incorrect.

Exceptions:

The right of withdrawal does not apply to:

  • Custom-cut fabrics or items made to your specifications
  • Sealed goods that cannot be returned for health or hygiene reasons once opened
  • Perishable or personalized items 

8. Warranty, Product Quality, Returns & Liability

8.1 Legal Warranty

Under Dutch and EU law, you are entitled to receive products that function properly and conform to the agreement. JK Fabrics does not provide any additional warranties beyond those required by law.

If a product is defective or non-conforming:

  • Contact us at [email protected] as soon as reasonably possible, preferably within 14 days of discovery, including photographs and your order number.
  • We will repair, replace, or refund the product in accordance with statutory rights.
  • Return shipping costs for faulty or incorrect items will be reimbursed.

Claims will not apply if the defect arises from misuse, negligence, normal wear and tear, improper storage, or alteration by the consumer.

8.2 Product Description and Representation

We make every effort to display product colors, textures, and descriptions accurately.

Slight variations in color, texture, or weight may occur due to screen settings, lighting, or dye batches and are not considered defects.

8.3 Measurement and Cutting Tolerance

All fabrics are cut to order. A tolerance of ±2 cm per meter is considered acceptable.

8.4 Intended Use

Our fabrics are sold for general craft and decorative purposes.

You are responsible for ensuring suitability for specific uses such as clothing, upholstery, or outdoor applications.

We recommend ordering samples before purchasing larger quantities.

8.5 Batch Variations

Color differences may occur between different dye lots. Exact color matches between separate orders cannot be guaranteed.

8.6 Limitation of Liability

Our liability for defective or non-conforming goods is limited to the purchase value of the goods.

We are not liable for indirect or consequential losses, including lost profits or project delays, except in cases of intent, gross negligence, or personal injury. 

9. Complaints and Dispute Resolution

Agreements between the JK Fabrics and the consumer are governed by Dutch law.

Complaints regarding the execution of the agreement must be reported in writing to [email protected]. We will respond to complaints within 14 days of receipt. 

If the complaint cannot be resolved within this period, we will notify the consumer in a timely manner and provide an indication of the expected timeframe for resolution.

If a solution cannot be reached directly between the JK Fabrics and the consumer, the consumer has the option to submit the complaint:

 10. Force Majeure

We are not liable for delays or failure to perform our obligations if caused by circumstances beyond our control, including but not limited to natural disasters, strikes, transport disruptions, or government actions.

If delivery is delayed for more than 30 days due to such circumstances, you may cancel your order and receive a full refund.

11. AI-Generated Images

Some images on this website are generated using artificial-intelligence tools, including OpenAI’s ChatGPT. These visuals are used for illustrative purposes only and may not accurately represent actual products, colors, or textures. Any resemblance to real persons or copyrighted materials is unintentional.

By using this website, you acknowledge that AI-generated images are approximations and should not be relied upon as exact depictions of the products offered.

 12. Privacy

We process your personal data in accordance with the EU General Data Protection Regulation (GDPR).

Your data is used solely for order processing, communication, and delivery, and is shared only with necessary service providers (e.g. payment and logistics partners).

We may update these Terms from time to time. The version in force at the time of your order applies to that purchase.
